I cannot reproduce this problem:

kirkland@t61p:~$ passwd
Changing password for kirkland.
(current) UNIX password:
Enter new UNIX password:
Retype new UNIX password:
Sorry, passwords do not match
passwd: Authentication information cannot be recovered
passwd: password unchanged
kirkland@t61p:~$ echo $?
10

Are you absolutely sure you're on a fully updated Intrepid system?
