I believe I may have found the cause of this bug, the NoteMenuItem class appears to be unchanged and is constructed as if it was a status menu and not an app-indicator menu, this is possibly also the cause of; https://bugs.launchpad.net/ubuntu/+source/tomboy/+bug/627744
