I suggest we pick the lesser of two evils and always have the driver respond the wireless is available. it _will_ cause problems if Karmic is released with a default mode of operation which prevents users from using the wireless network.
I prefer having nm-applet think the network is present even when the hardware is off than having no way to activate it.
