Replacing 'return;' with 'goto out;' appears to be the exact solution upstream has chosen. Please try a more recent kernel to confirm, perhaps something from the mainline vanilla series at http://kernel.ubuntu.com/~kernel-ppa/mainline, or a recent Karmic kernel from https://edge.launchpad.net/ubuntu/+source/linux
