It has not made it into the Ubuntu git. However the patch is available in the ubuntu-hardy-openvz kernel git at openvz:

It was committed on April 17th which is far too close to Ubuntu's release date. I'm assuming that we will see these changes in the 2.6.24-17. Till then at least we have a solution.
