I can confirm that Hardy is now using ~/.local/share/Trash as it's trash dir.

Freedesktop Spec for Trash: http://www.ramendik.ru/docs/trashspec.html

It should be: $XDG_DATA_HOME/Trash

Work around: You can manually set the directory used by Trasher in gConf. avant-window-navigator/applets/Trasher/ trash_dirs
