I was starring at the "ProcVersionSignature: Ubuntu 2.6.38-6.34-generic 2.6.38-rc7" from the apport report, but i guess that the rc7 are the Ubuntu rc number.
It all makes better sense now, thanks a lot!.

So if there are ath9k fixes in rc8, we will just sit tight and wait to see if it solves it.
