Actually, the bug has been fixed when Ubuntu 9.10 adopted upstream stable kernel release 2.6.31.7 in the form of linux-image-2.6.31-17. See bug #480144
Ubuntu has since issued further kernel updates which also include the fix (we're now at -19).
I assure you that this newer kernel does indeed fix the problem: I am running Karmic on a Soekris net4801 box that I previously could not install the 2.6.31 kernel on due to this boot-time crash.
Please note that if you are installing 9.10 on such a box, rather than upgrading from a previous Ubuntu release, you will also need to use an ubuntu-installer package that includes the fixed kernel. So please use the ubuntu-installer files from
